Ask the Expert Terms and Conditions
These Terms and Conditions (“Terms”) govern participation in the “Ask the Expert” feature (“Feature”) accessible through the Sustainable Mining Community (the “Community”). By agreeing to participate as an expert (“Expert”), you acknowledge and accept these Terms.
1. Purpose of the Feature
1.1 The Feature provides users of the Community with access to insights from individuals with relevant experience, including but not limited to senior executives from the mining industry, community members, and First Nations community representatives.
1.2 The purpose of the Feature is informational only. It is not a platform for commercial promotion, legal advice, or corporate advocacy.
2. Eligibility and Representation
2.1 Experts are selected based on their relevant experience, knowledge, or community insight.
2.2 By participating, you agree that:
- You have the experience necessary to address the topics on which you comment;
- You will provide information in good faith and to the best of your knowledge;
- You will comply with all rules of the Community and its Forum as outlined in the website terms and conditions here and Forum guidelines here.
3. Content Submission and Public Display
3.1 All responses submitted through the Feature will be publicly visible on the Community.
3.2 Your responses will be stored indefinitely and may be referenced, indexed, or archived as part of the Community’s publicly accessible information resources.
3.3 Submitted answers will not be edited, except in cases where:
- They violate these Terms;
- They breach the Community’s terms and conditions or Forum guidelines;
- They contain offensive, defamatory, harmful, or otherwise restricted content.
In such cases, the Community may remove or decline to publish the content at its sole discretion.
4. Photo and Biography Submission
4.1 Experts must submit a photograph of themselves that may be displayed next to their profile or responses.
4.2 By submitting a photo, you grant the Community a royalty-free, worldwide, non-exclusive license to display, reproduce, and store the image for the purposes of supporting the Feature.
4.3 You must have the rights and permissions necessary for the photo to be published as per above.
4.4 Experts may also submit a written biography that may be displayed on the Community as part of their Expert profile.
5. Prohibited Conduct
Experts must not, in any response or submission:
5.1 Identify or allege wrongdoing, faults, or deficiencies of any specific company, organisation, or individual.
5.2 Promote or advertise any company, service, product, or personal commercial offering.
5.3 Share confidential, proprietary, or non-public information belonging to any organisation or community.
5.4 Provide legal, financial, or medical advice.
5.5 Submit content that is offensive, discriminatory, derogatory, harmful, or unlawful.
6. Ownership and Licensing
6.1 You retain ownership of the original content you submit.
6.2 By participating, you grant the Community a perpetual, irrevocable, royalty-free, worldwide license to store, publish, display, distribute, and use your responses for informational and archival purposes.
7. Disclaimers
7.1 The Community and its operators do not guarantee the accuracy, completeness, or reliability of information shared by Experts.
7.2 Expert responses represent the personal opinions of the individuals and not the views of their employers, communities, or the Community.
7.3 The Community and its operators are not responsible for any decisions or actions taken by users based on Expert responses.
8. Removal or Suspension
8.1 The Community reserves the right to remove any content or suspend an Expert’s participation if they violate these Terms.
8.2 The Community may discontinue or modify the Feature at any time.
9. Privacy
9.1 Expert submissions, including names, biographies, and photos, will be displayed publicly.
9.2 Additional personal information collected for administrative purposes will be handled in accordance with the Community’s Privacy Policy.
10. Indemnity
By participating, you agree to indemnify and hold harmless the Community, its operators, and affiliated organisations from any claims arising out of your participation or content submission.
11. Acceptance of Terms
By participating as an Expert in the Feature, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
